venturepro
Hello,I have an old debt that was apparently purchased by an attorney in my state. After receiving several collections letters at a P.O. Box in a town I used to live in, I noticed online that they set a court date and issued a summons. The summons had my old address on it and after a couple of weeks, the summons was returned because they didn't find me.I'm curious what might happen now. The court date is set for early next month. Do any of you have experience in this area?
IHateCAs
They will probably reissue the summons in some fashion.
venturepro
Thanks for the reply.I have heard of default judgments. Is that something that could happen here?
IHateCAs
Technically, not until you are actually served.
willingtocope
It is difficult to say how summons are handled in the state of WOW. In some states, they can just post a summons in the newspaper, or nail it to the fence. You need to check with your local courthouse....

venturepro
Okay, I'm in Missouri. This happend about a year ago on another account and after the summons was returned the docket said somthing like dismissed by parties without prejudice. I never heard from them again. My only concern is if they decided to try to get a default judgement.
willingtocope
Well, you'll have to check your state's rules to see if they actually have to deliver the summons. You might call your local courthouse to see if somethings been filed.
