blooker
They are re-aging my account. So I paid for a Equifax report today because when I tried getting a copy through annualcreditreport.com they said there was a security freeze on my account and I couldn't get in touch with a live person at Equifax. I said WTH and paid the ten bucks. The Transunion and Experian reports did not provide me enough info.NCO is reporting my Last Date of Activity as 11/2000 (clearly the SOL for Colorado has expired. I was concerned that they were going to try to go after me claiming it was a written contract therefore the SOL is 6 years.) They are reporting Date of Last Payment as 4/2006. I never paid them any money! I haven't made any payments to restart the SOL! They are clearly trying to re-age this. They were hit with a lawsuit by the FTC in 2004 and fined $1.5 million for re-aging accounts. I am meeting with two consumer rights attorneys tomorrow. I also am contacting the FTC. I hate EXP
They'll fold. Just make sure you have your DV' in . I've made NCO drop stuff off of my report and I've made portfolio give me money for coming after me for suing after recieving a DV outside of SOL. It might not hurt to send a DV to both the CA attorny and the CA so you can go after both
blooker
I sent a certified DV to the NCO's attorney. Should I also send one to NCO?How did you make Portfolio pay? NCO is suing me for an account in which the SOL has expired. Do you think they will just drop the lawsuit? I am kind of in the mood to make them pay for thinking I am stupid. I should sue them for the cost to file the answer, losing sleep, my prescriptions for ambien and valium. I read online case reports on the county court website with NCO as the plaintiff. They only win because the defendants don't answer or show up for court. I read a case where the guy didn't show up and he filed a motion to vacate and won the case without prejudice. bird
Sorry I just crossposted on another thread that had to do w/ NCO when this was the thread. The same thing happened to me. My credit report says the last payment for an account that NCO is handling and was in 11-2006 but I haven't paid on this account since 2003. I recently received a citation that I have to answer. Do I just answer by saying that the claim is wrong or do I have to say that they were not w/in the SOL? (If this proves to be the case for me. ) I tried to call Equifax but it's hard to get through to them. How should I go about this? Would calling the attorney general be the best thing for me to do next? Thanks.
MadinKS
I tried to call Equifax but it's hard to get through to them.I noticed you are in TX. When you say EQ, are you referring to CSC? If you are talking about CSC, read this. CSC Credit Services (for those of us unlucky enough)If you have CSC (first off I'm sorry) instead of Equifax, and you need to speak to an individual, the ph.# is 281-878-1900. DO NOT CHOOSE OPTION 1. Just stay on the line and let someone answer. Thought I'd pass it on. The sticky # is disconnected BTW. Just got the FAX # 281-878-5088
