InsideTexas
(see bottom for disclaimer on where I did search for this.)I've read that some people dispute based on the inaccuracy of delinquency reporting. I've got one OC that has done that (on top of other violations) that I'm suing, but what about the rest of them?I've sent all three CRA's proof of the different reporting. To me, that is not "accurate and correct" information if one of the TL's has three different lates on three different reports! Some of the seasoned vets on here have said it's a weak excuse to sue, so that's not going to fly (except it's another round of ammo on my above suit with another OC over a multitude of things.)I feel the basis for my claim is substantiated by this fact (but hey, it's also my butt if it isn't so I'm a tad biased ), but I don't know if they will go for it. Experian sent me a letter today saying they won't investigate anymore without evidence...well I sent them some. $.89 plus CMRRR fees Lots of paper in that envelope (TU and EQ got theirs as well)Anyone had any luck this way? Goodwill didn't work, so if this doesn't I guess I'm stuck with them...? I sent dispute letters out to the 30-day lates asking what sort of information they verified with to the CRA's, but so far nothing has come of them.I read this thread (http://www.debt-consolidation-credit-repair-service.com/forums/showthread.php?t=212365&highlight=dispute+delinquencies) but nobody posted what happened when they disputed the varying delinquency reporting.I need better keywords...There has got to be a concrete "yes I got them deleted using this method" or "no they didn't delete" out here somewhere. GucciMark
got this from the sticky < How to have Paid Collections Deleted >Here's how I recently removed a paid collection:1) Sent a dispute letter to the CA. This is the same as a DV letter, except I replaced "debt validation" with "dispute" in the letter.2) Disputed the TL with all 3 CRA's. All Came back as verified.3) Sent the CA an ITS letter outlining their FCRA violations. Gave them 7 days to remove the TL's and pay me.4. Checked my CR's and all TL's are gone! InsideTexas
They are not collections...the OC is different than dealing with CA's.
divemedic
They are still bound by the FCRA
InsideTexas
I know that much, I just didn't know if anyone has had luck dealing with disputing for that fact alone. That's all I have one some of these negative tradelines. However, if they don't report accurately but tell me I'm FUBAR'd do I have any recourse? Some on here saying suing for such a 'minute' issue wouldn't really be a strong case in court. InsideTexas
I HAVE ALREADY READ IT.You aren't getting it. I'm asking if anyone has had success with this.I know they are bound by the FCRA. Dive's primer deals primarily with CA's and doesn't delve into details as to what to do if the OC's won't work with you.IM ASKING THIS: Has anyone had success in deletion VIA disputing the wrong delinquency reporting? divemedic
You aren't paying attention- the process here is not just about writing letters and having the TL's magically disappear. Sometimes the only way to get the delete is to sue. The OC and CA doesn't "work" with you- they obey the law, or they don't obey the law.If they do not obey the law, and do not delete, YOU SUE THEM, or you learn to live with the TL. The OC is just as bound by the FCRA as the CA's are. To answer your question, yes it does work, but you sometimes have to sue to get there. If any furnisher (CA or OC) verifies a dispute with the CRA as being complete and accurate when you can prove that it is not, and especially if they do it more than once, you sue them for willful non compliance and FORCE them to OBEY THE LAW. I knew to sue, but on your primer, you went on about an OC for a bit, but then it kinda stopped and just stayed with CA's.Then I saw where some people disagreed with suing just over wrong delinquency reports...well I was getting discouraged.
