Equifax verified with CA, but I couldn't?

Recommended Posts

Using the address on my Equifax CR for the CA of one of my collections, I sent a DV letter to them. It came back undeliverable, but yet I received a letter from Equifax yesterday that they had verified it with WCI and that it is mine.

how'd they do that? Surely not with the same contact information supplied to me on my CR with them.

I know my next step is to send EQ a MOV letter, but should I mention that I tried to verify with their contact info and that it was sent back to me and how did they do it with that info? Should I send them copies of the returned envelope?

Thanks!

:-(

Do a search for "eOscar". That will explain how the data furnishers can verify w/ CRAs but won't accept or respond to your DV request.

Who's the CA? Have you done a Google search for the company to get an updated address? The BBB is a good source to get that info as well.

Thank you, Angel.

I found this: http://www.e-oscar.org/about.htm

So then, EQ should reply to my MOV request that they have either verified by telephone or eOscar?

If they say the did it by mail, then I know they are fibbing, right?

The thing is...a MOV's only purpose is to serve as paper trail when you're planning to sue. If a CRA responds, you'd get the generic letter telling you that they use a computer system to verify & blah blah blah. Even if they don't respond, it still won't get you a deletion and you can't sue for that violation; you can however report them to the FTC. Purposeless, right? Exactly. It's just a step you would take in case you are building a lawsuit against the CRA (as additional support for your claim). If you are attempting to sue a data furnisher, then a MOV can help show the courts how you tried to cooperate w/ the CRA to no avail. So, if you have no intentions of suing, then IMO, you shouldn't waste your time on a MOV. You might want to fight this w/ the CA. Is the debt not yours? Did the CA violate any laws? Is the listing inaccurate? Are you willing to offer a PFD? These are just a few questions you need to ask yourself b4 you proceed, as the answers will determine what your need step should be.

Who is the collection agency? It's possible that others on the forum may have a current address. Personally, I would MOV the CRA's because I do want to have a paper trail. I had the same thing happen to me with a phone number listed that was not a working number! I asked them how did they get an answer when I couldn't? All of this was my way of gathering information to file suit against them in small claims court. It wasn't long after that that the item dissappeared. 8-)
