myscoresawful
Ok, so I have a collection account on my credit report from a dentist office back in 2003. I REALLY don't believe it is accurate. It shows the original balance as $181.00, interest as $66.00 for a total of $ 247.00.I disputed this a couple of years ago and it came back "verified' and I didn't know any better at the time that I had "rights".Ok, so I DV'd the CA 2/28/07 and then disputed with EQ once again. I have not heard anything back from EQ yet, but here is what the agency sent to me:Dear April,Please find enclosed the information requested regarding the above referenced account. If you have any questions, please contact the undersigned, etc etc etc. They attached a copy of the contract for payment that I had signed with my dental office for the work I was having done at the time. Now, this is a genuine contract signed by me, but here are the only figures noted ANYWHERE on the contract:"Subject to the foregoing, the undersigned promises to pay the estimated total sum of $1032.60 as following:(a) Downpayments (i) $3.80 on signing of this Contract Note; and (line "B" is crossed out where it references any monthly payments)© All remaining sums owing must be paid in full no later than 4/30/03 or earlier in case of acceleration or increase in the undersigned's share of the payment from that estimated on Exhibit "A" for any of the reasons described in paragraph 3 above.(D) This note reflects an estimated insurance amount of $1028.80.ok, so where does it say I owe them $181.00? Where are they showing me that I owe that?It looks to me like they are showing me what I thought all along: between my little downpayment and my insurance company's payment, it is PIF!?right?Someone please tell me if they have validated the debt of $181?Thanks! renec
I don't think they showed you validation of debt. I am a newby though. Congrats on all of the progress you've made since Feb. Seeing that makes me hopeful. I have letters ready to go out in the mail and I am nervous that it is the wrong approach. Would you be willing to give me advice? I have been spending the past 2 months learning the credit repair business. Maybe we could trade information. Any takers?
IHateCAs
They must show you how the current balance was calculated. Showing you that you entered into an agreement creating a debt does not do that, only that you created a debt.
Recovering Attorney
You need to contact them again and repeat that you dispute the debt. You don't dispute the dentitst did work for you, but you still do not understand how, between your payments and the insurance, they have a balance of $200, so you therefore continue to dispute and deny the item. Since they are aware you dispute this, they should delete it from your CR or, at the very least, show it as a dispute, or they will violate the FCRA and FDCPA

March 27, 2007Aprilsomewhere 123TNReliant Recovery Services, INC2210 East Route 66, suite 101Glendora, CA 91740Ref: Western Dental Account number XXXXXXDear Mr. Stuart,Thank you for taking the time to reply to my request for validation of the above mentioned collection account that is currently being reported by your agency on my credit reports. In my original letter, I requested copies of any bills or invoices that Western Dental had supporting this outstanding amount, as I have NEVER received anything from them showing any amount owed. I also requested you to provide me with a copy of any contract that I might have signed, and you did. However, Mr. Stuart, the contract that you supplied me with only supports my belief that this account has always been paid in full. It shows the amount I was charged for the dental work, the amount my insurance company paid, and the amount of my down payment that was paid at the time I signed the contract. All of this leaves a balance of $0.00 on the account, so the copy of the contract you supplied me with is not documentation of a debt that you are reporting to the Credit Reporting Agencies. There is nothing in the documentation that you supplied me with that even mentions the $181.00/$66.21/$247.51 that is being erroneously reported on my credit report.I have disputed this account a couple of years ago with Equifax and it came back as being “verified”. That was before I was aware of my rights under the FDCPA. I am aware of them now and have re-disputed this with the Credit Reporting agencies that you are reporting it to.This is my last attempt to have the debt validated by your agency. Please, either send me copies of bills that you have from Western Dental, or remove your reporting of this debt from the Credit Reporting Agencies you are reporting it to.Best regards,April

How soon after you send in disputes should it show on the CR that the items are disputed? If they dont show them as disputed what can you do about this? Most do not and that is how you tally up violations. Do a search on "1-2 punch" and you will get loads of info.
