After Initial DV....

Recommended Posts

I sent in two DV's and recieved my green cards back, since then it has been over a month with no response from either collector. Neither of these collections were on my credit report. My question is what I should do next, should I send a follow up letter and if so, what should it contain seeing as it hasnt been reported to the CRA's??

Thanks in advance for any and all help.

Mike

I dv'd within the initial 30 days of recieving their letters, no response after 30 days of getting my green cards back. These arent on my CR's, so I dont need to get anything removed, but i still dont know what to do.

You don't have to do anything! xbeer2) They're not on your credit report! :D Just continue to watch your reports. xtvx

Exactly right. And the CA has to notify you in writing if they are going to report these to the CRA's. If they don't, you have a violation and can sue them.

That law only applies to lenders, not CA's.

(i) IN GENERAL- If any financial institution that extends credit and regularly and in the ordinary course of business furnishes information to a consumer reporting agency described in section 603(p) furnishes negative information to such an agency regarding credit extended to a customer, the financial institution shall provide a notice of such furnishing of negative information, in writing, to the customer.

Since you timely DVed, save your green cards, CM receipts, USPS receipts, photocopies of your DV letters, and keep a file on each. Watch your mailbox, but don't panic and don't get paranoid.

If these were your only adverse TLs, then you are in pretty good shape--but that does tend to make you a more desirable target for ID theft. Pull your CRs free every year, and maybe monitor it with a monitoring service for a month at a 3-6 month interval in between.

How old are these collections? If you are disputing them within the first 30 days of their initial contact with you, they must cease all collection activity until they validate. If it's after the 30 days, they don't have to respond to you anyway.

So if you have two Cas on your CR that are more than 30 days old, and you DV them, and they DONT respond. Should you assume to just pay them? Or do you send another notice?????? Hmmm curious, and if one did respond for collecting on a hospital bill and I was priorly paying them last year and had to stop to make other payments... Is what they sent me satisfactory or does it even matter because I was paying them...

I would not pay them, that is for sure. What I would (and have) do it to find another way. The FCRA can be used, as can state law.

There are always ways. Aside from one paid collection (that I paid before I knew about credit repair), I have not lost yet.

What happens if they DV after 30 days can they still put it on your CR even if it was after the 30 days?

Actually, you're required to DV within 30 days of your initial written contact from the CA, but they can take as long as they want to validate. A week, a month, a year, 10 years. Does not matter.

What matters is that once you DV, they cannot write, call, report, sue or otherwise pursue collection efforts until they validate. If they try to collect before validating, then they are in violation.
