CA account drop off CR

I have a derogatory account in collections with Fidelity Properties for $254.00

On my CR it says date opened 10/27/04 and date reported 2/1/2007. The actual bill was from an ER visit in early 2004. I read that the 7 years a collection stays on your CR started 180 days after you missed a payment and before it is sold to a CA. I checked my credit report last year and this was on there. So does the 7 years start over now because the CA reported AGAIN last month? If it doesn't how do I go about updating my report. Thanks in advance for any help!

No. The FCRA Statute regarding the 7 year reporting period is quoted below. Basically, the 7 year run starts when you first went delinquent. That date is not at all related to the Date Opened or Date Reported. You need to find out the DOFD (Date of First Delinquency) on the account and go from there. Usually, the official TU report (you get in the mail) will show a lot more detail than the others. Are you just looking online or have you received your reports in the mail?

§ 605. Requirements relating to information contained in consumer reports [15 U.S.C. §1681c]

(1) In general. The 7-year period referred to in paragraphs (4) and (6) 3 of subsection (a) shall begin, with respect to any delinquent account that is placed for collection (internally or by referral to a third party, whichever is earlier), charged to profit and loss, or subjected to any similar action, upon the expiration of the 180-day period beginning on the date of the commencement of the delinquency which immediately preceded the collection activity, charge to profit and loss, or similar action.

Even though you are on TC online they don't provide you with alot of the information you would get from ordering each credit report directly from each CRA. I would order all 3 separate CR's (it's good to have these anyway). Have you taken advantage of receiving your free annual CR's? If not, go to https://www.annualcreditreport.com/cra/index.jsp

and when you get those, between the 3 of them you can determine the information you are looking for. Good luck.
