My situation: Collection was written off in 2003 and was purchased by another lender. This lender has placed with 3 agencies. I have timely validated each time, and there has been no further action from the collection agency. It is no longer appearing on my CRB. This is the last of any debt I owe. I made some payments on this account to a CA, but was unable to continue in mid 2004. Since, then it has been placed with the 3 agencies, and each time it gets placed, I get a hard iquiry on my CRB. I would like to purchase a house in the next year, but fear this my stand in my way. At this point I'm willing to pay a an amount to make this go away forever. They are claming right now the at 13K is the debt. Its not that much. Either that or they can't validate it. In any case, depending on your state it's more than likely outside of SOL so even if the CA sued you they couldn't collect (if you used that as your defense). At $4.64 a pop (going up to $4.66 a pop in May), CMRRR beats paying what will likely be a lot more.In KS, the SOL is 3 years for oral and open-ended, 5 years for written and promissary notes.http://www.creditinfocenter.com/rebuild/statuteLimitations.shtmlIf this is a CC from 2003, then the SOL would appear to have run. If the SOL is up, then I agree with kevin3344 and you should C&D.Since you're having success killing it by DVing and disputing, I say keep it up. Big Time Posted April 4, 2007 Report Share Posted April 4, 2007 Because if the CA finds out that you are house-shopping, there will be a tradeline added, asking 3 times the amount you legitimately owe. The hills have eyes.Try searching for the "subsequent CA letter" and see if that might help you if you haven't ever recieved actual acount statements from any of the CA's. JeBas8160 Posted April 4, 2007 Report Share Posted April 4, 2007 Hello, I'm new here but not new to debt collectors, unfortunately.My recent headache is with a debt agency (legal group??) claiming I owe over $8K for a credit card that I don't remember having, (the collection agency purchased this from what I can discern, from another collection agency, who I have not knowledge of) They are telling me the original creditor was CitiB. Last year there was a similar situation with another creditor who garnished my salary and took money out of my checking/savings account without giving me a chance to respond. Some of the money I did owe, but almost half of what was collected was from said fee's and interest which cost me almost double the original debt. This one is now satisfied, but they have not given me anything in writing even though I called and asked for this in writing. It's been over a year. Now this "new concern is with CitiB" and the debt collector, I received a threatening letter that they have filed a claim to collect the debt and I must supply all my personal and banking information to them at once or they will have me arrested or seize my home and property. They also did something with the NJDMV and I received a letter from them stating that I had to turn over to the DMV my car title. I feel so helpless and bullied. I don't know what to do. I was a former employee who worked in the World Trade Center during 9/11. Shortly after I became ill and after struggling to work I went out on SSDisability. I have no money as it took them a year to approve my claim. I lost my health insurance and my house was in and out of forclosure a number to times. I had to cash in my meager retirement fund to pull my house out of forclosure, pay some other bills and for medical expenses. At this time my income just barely pays my mortgage and taxes. I owe smaller debts of a few hundred dollars here and there and my credit is a mess. This is all due to my failure and ignorance to plan for my financial future and compounded by my illness which keeps me home and pretty much in bed.I have been told that I make too much money to qualify for any assistance and I rely on friends and family to pay for food, medicine, phone, electric and fuel oil. I already have several small judgements filed against me and I'm very behind on my property taxes. I've worked all my adult life and I've never been in such a poor financial situation. I want to keep my house, and my seven year old SUV. These blood suckers who are after me for more money than I can remember owing anyone have put me in a real hot seat.From what little I've been reading on this site, do I write to this collection legal firm and ask for proof of the debt, the original amount and confirmation of the original creditor?
