HELP only have 24 hours

Before finding this site I was contacted by a company called Allied Interstate. They were trying to collect a debt for Capital One. (they said)

This was before I knew about debt validation.

I authorized them to take $399 out of my checking account as 1 of 3 future payments. This was a settlement of $1,200 offered on a $1,500 bill.(they said)

The next payment is scheduled to come out Monday, April 2.

Although they contacted me December 6, 2006 I sent them the debt validation letter today (registered, but not within the 30 days)

I really would like to lock them out of my checking account now, until they validate the debt. Even to the point of getting a new checking about and not having the funds available to them. They will still try to get the money.

Don't even remind me how stupid this was on my part.

What should I do?????

The first thing I would do would be to contact my bank and explain to them that you would like to stop payment on the electronic withdraw coming up April 2nd.

It could be that your bank can't/won't do this for what ever reason. They may ask you why you want to stop the payment, and in light of making yourself sound like a deadbeat that just wants to get out of paying, you could say something like, "I authorized the payment before I realized it had already been taken care of" or something like that.

If you make the funds unavailable, you will not only get charged an overdraft fee, but your money will never be safe in that account again because they can always come back at a later date when it is in there and withdraw then.

In this case what I did in the past is place a stop payment on my account for the transaction and company, I just told the bank, that I had revoke the authorization and wanted to make sure it was stopped on this end. I did send the company a letter revoking the authorization pending a review of the verification once I review it.

To my understanding, any bank has to stop or attempt to stop anything you ask them to stop, I however do not know if there are any of legal issues there.

I would try to take it one step further and explain to the bank that Company X is not allowed any withdrawls until you authorize it. I don't know if they will do that but at least it's a shot. Don't forget to write down the person's name that you speak with and the date and time. That way you have an out if it comes to push and shove with your bank. Good luck! A lady at my bank had told me to never give out that info because even if you stop payment they will likely try again and again. I would go talk to someone at the bank explain some of the situation that maybe you accidently gave out your banking info and they might close that account open a new one you would need to be able to list everything that is outstanding that should be coming in soon so that they will pay those items.

It baffles me that anyone gives banking info to a stranger calling on the phone. It's really easy to say no. No. See, it's easy. No. No. No. Make it a rule for yourself to never give banking info to a CA. Don't even pay them with a check from your checking account.

ask them.you dont need an excuse.. just say you want to revoke it.. and if it is an issue.. open a new account and close this one as soon as everything clears

I have had to stop payment on probably 3 checks in my entire life, and on the form you fill out, it always asks "reason for stop payment"...

that is what I was referring to. I wouldn't want anything on paper that was misleading down the road.

Wow, how much do I love this website.

I was really out there in "what if" land wondering if I would be sued or what, for revoking this payment authorization. Now?.....so what..........screw em and I will fight hard (with the help of this website)

I am off to my bank this morning to open a new account and close this one.

Thank you Aisle4, I consider myself spanked and have learned my lesson. Never ever give your account information to anyone.

I sent the DV letter yesterday registered, don't know if that's ok since its past the 30 days since first contact.

What I do know is it's my right to know who this CA is. I tried to call original creditor to pay, but they wouldn't talk to me. They transferred me to recovery and these people, Allied Interstate, answered.

Right, I thought about that. They could sue me for revoking the payment authorization......and they already got one payment from me back in march. the balance is 800. I definitely feel much better with my money in a new account and my banks word that CA can't touch it.

Lesson learned, will never, ever pass go or collect $200 without some heavy research from this site and others.

Has anyone out there been sued for revoking payment authoriation?

I am with you on that one.. you don't give this information to 99% of the people you know personally.. why in the WORLD would you hand it over to some stranger in a cubicle.. this has always baffled me as well...

and FYI.. some of these calls centers have now gone over to India... yes the COUNTRY.. seriously.. do we want that information overseas now too....

Apparently this "United Allies" has been assiged to me through Capital One. So I will still have be pay, United Allies say they don't own the debt, I just would like to know pretty much WHO they are without taking their word for it.

You have created a monster. I have yanked ALL my money out of my bank including any direct depostis until further notice. Good Luck getting it from there.
