Summons not yet received

Hello, I am being sued by CITI bank for a past due credit card. The problem is I have not yet been served with a summons. CITI bank filed on 1/31/07 it's now 3/29/07. Is there a certain time period for me to be served? If they can't find me to serve me what happens? What do I do? I tried the debt validation method and when they supposedely validated it, which was not what they did, they only sent statements and nothing else. Someone please help! I am stressed out over all of this!

If you haven't been served then how do you know you are being sued?

How do you know they filed?

I would wait until served.

Most courts have time limits on an action such as 6 months or 1 year. However, some states allow for substituted service (ex. newspaper notice). Also some states allow the case to proceed when the plaintiff files for a non-proof of service hearing.

When you are served, answer the complaint (you have limited time- max 30 days). In the complaint, state the debt is not yours and when you ask for discovery, request contracts, etc from the creditor.
