AFNI put 120 days past due on account after phone call

I am new here, and just getting started.

It is for an amount ($156.00) I disputed with Altell before 2000. I closed the account and went to another carrier because of this dispute.

I have a "Trimerge" credit report (on 03/08/07) from a mortgage company which shows the last payment on this in 06/01, which is not true...the account was closed in 1999.

Before I read enough to know anything about credit repair and dealing with CAs , I disputed the account online with TransUnion and Equifax. The TransUnion dispute replied within hours with an email stating "Info Disputed Meets FCRA". Many days later I called AFNI about a collection item on my CR. To tell them why the debt was not paid, and why I did not intend to pay it. Now I know this was a big mistake..right?

I looked at my CRs on Truecredit.com, and now the item on EquiFax under AFNI-BLOOM with the Pay Status as "late 120 days". The reported date is listed as 2/2007, but thsi pay status was not on the report I pulled on 3/27/07.

Is it too late to DV this item now?

Should I just pay this to make it go away?

I just downloaded the DV flowchart from Admin. Will use this going forward.

thanks for any help.

I forgot ....

I live in NC the statue of limitations (in years):

Oral Agreements - 3

Written COntracts - 3

Promisery Notes - 5

Open Accounts - 3

AFNI is in Illinois statue of limitations (in years):

Oral Agreements - 5

Written Contracts - 10

Promisery Notes - 6

Open Accounts - 5

It was listed on CRs as Open Account, but not sure which category applies, and which state's SOL applies.

AFNI's state is irrelevant.

This account (if last date of payment was 1999) has been illegally reaged.

I would send an email to GARYBROWN@afninet.com and tell him that this debt is not only out of statute, but they have illegally reaged the account and if it is not off in the next 24 hours you will sue since you are currently seeking credit and it is affecting your interest rates, you will get actual damages in addition to statutory damages!

Contact your state AG as well and note that at the bottom of your email:

I noticed this item is listed with two different CA names on the CRs:

as AFNI, INC. on Trans Union and Experian

as AFNI-Bloom on Equifax.

Is the email address good for both?

sorry for the questions, but I am a Newbie, aand this is my first action. I was going to DV them, but this will achieve the same end...remove from CR... Right?

I have a form from the NC AG's office, they woiuld not give me an email address.

I will send them a hard copy of the email I send to AFNI.

Questisons:

Do I need to reference a specific section of the FCRA regs?

Is there a sample/template for this email?

Do I Dispute it with the all three CRAs at the same time?

Before I had found this site to learn how to do all of this, I had already disputed it with Trans union online and CRA updated it to "Disputed Meets FCRA" very quickly. Will this effect any thing?

I sent an email to gary brown and have not heard from him as of yet which probably means he ignored my email. The good thing about email is that i have the service read notify email service. I read above that you send it to the attornery general. Is it to the state AG where CA is located or where I am located? Also, I would like to know how do you write a response to the BBB on this company. If someone has a sample, can you either email me or post in the forum to help other newbies like myself?
