does NY sol start at dofd?

Recommended Posts

Hi, I have a few questions. Does the NY sol start at dofd or 180 days after dofd? Does a charge off/collection just drop off my cr after the 180 days + 7 years or will I have to request to the cra that it be dropped from my cr? Also, If I contact the cra's for my free cr's will it show up on my cr's and give information to oc's and ca's that they can use against me? (like correct ss#,correct adress, dob and so on since my cr's list differant ones for each item) One last question ...I promise, Can a oc or ca put a out of sol debt back on my cr once it's been removed because of sol, like if it's been resold to a differant ca, can they report it again? Thanks for reading, John

Does a charge off/collection just drop off my cr after the 180 days + 7 years
§ 605. Requirements relating to information contained in consumer reports [15 U.S.C. §1681c]

© Running of Reporting Period

(1) In general. The 7-year period referred to in paragraphs (4) and (6)

3 of subsection (a) shall begin, with respect to any delinquent account that is placed for collection (internally or by referral to a third party, whichever is earlier), charged to profit and loss, or subjected to any similar action, upon the expiration of the 180-day period beginning on the date of the commencement of the delinquency which immediately preceded the collection activity, charge to profit and loss, or similar action.

It is supposed to. Sometimes you will need to dispute with the CRA's to remove because the get "overlooked".

The SOL starts from the DOFD.

Also, If I contact the cra's for my free cr's will it show up on my cr's and give information to oc's and ca's that they can use against me? (like correct ss#,correct adress, dob and so on since my cr's list differant ones for each item)

It should not alert them to your position. Not unless you update the info and they pull your CR.

If a debt is out of SOL it just means that you can use that as a defense in court if they sue you. They can still report the debt until the end of the 7 years. And if the debt is sold to another CA they can report the same debt. It sucks but legal as long as the reporting period is within the 7 years. Sorry.

So no matter what ca's cannot report to cra's after the 180 days + 7 years is up on the charge off/collection?

Depends on what the debt is for.

§ 605. Requirements relating to information contained in consumer reports [15 U.S.C. §1681c]

(a) Information excluded from consumer reports. Except as authorized under subsection (B) of this section, no consumer reporting agency may make any consumer report containing any of the following items of information: (1) Cases under title 11 [united States Code] or under the Bankruptcy Act that, from the date of entry of the order for relief or the date of adjudication, as the case may be, antedate the report by more than 10 years. (2) Civil suits, civil judgments, and records of arrest that from date of entry, antedate the report by more than seven years or until the governing statute of limitations has expired, whichever is the longer period. (3) Paid tax liens which, from date of payment, antedate the report by more than seven years. (4) Accounts placed for collection or charged to profit and loss which antedate the report by more than seven years.2

2 The reporting periods have been lengthened for certain adverse information pertaining to U.S. Government

insured or guaranteed student loans, or pertaining to national direct student loans. See sections 430A(f) and

463©(3) of the Higher Education Act of 1965, 20 U.S.C. 1080a(f) and 20 U.S.C. 1087cc©(3), respectively.

But generally, the 7 years is up, it's supposed to be gone. If it shows up dispute it. And if your like me, I have no idea what antedate meant so I looked it up. Here is the definition.

Main Entry: 1an·te·date

Pronunciation: 'an-ti-"dAt

Function: noun

: a date assigned to an event or document earlier than the actual date of the event or document

The CRA's will just ask the standard stuff. SSN, Full Name, Address, etc.
