I need help, please!!!

Im recovering from a Ch 13, discharged in Sep 06. My beacon score was 605, on average, until today. I checked it a while ago and it had dropped almost 30 points! After shi**ing my brick, I looked over my report and saw a collection agency from a medical bill in 2003 suddenly reported me as open and 120 days late, even though it is also listed as a collection.

This is how I think I messed up...

I made the mistake of calling them yesterday and trying to negotiate a pay for delete, which they declined. I complained about the rude witch that answered the phone, speaking to her supervisor. They seemed to have excellent records, right down to the Dr's name, so I dont think a dispute will work. My question is, can they report me as an open account with late payments, while also listing me as a collection account? Again, this is a collection agency, not the original creditor.

BTW, the balance owed is $53.00

You need to be very careful what you say to ANY collection agent. You can unknowingly reset your time-line for collection or even legally (and unknowingly) renew a collection effort that has otherwise slipped into the void of Statute of Limitations bringing it back into full legal status for collection. Such a situation can bring an old debt back onto your credit report for another seven year stay. Talk about a NIGHTMARE.

Tell me about it!!!! That account has been on my report for almost four years...I should have left it alone.

But can they list the same account as having two different status'? The other CRA is listing the account status as "derogatory" but no late payment comments.

What are the circumstances of this $53.00? Do you actually owe this $ to the doctor or not, did you have insurance at the time and do you have any of the EOB's?

Im not sure exactly what this is from. I remember disputing some bills because the insurance company was responsible for them. I dont recognize this particular one, though.

I just cant see how a CA can report you as "late", I thought only OC' s could do that.

BTW, what is an EOB?

An EOB stands for Explanation Of Benefits. It is a form that you should recieve from your insurance company every time they process a claim submitted to them whether is it submitted by you or the medical provider.

The reason I asked if you had it is that it would clearly show what, if any, portion of the bill you owed. Depending on your insurance you may not even owe that $ at all. It may be something that the provider should have written off. Always keep these to insure that the medical provider is not billing you for something you don't actually owe. It may be possible to contact your insurance company and still get some information regarding this bill. Have you contacted the medical provider? A lot of times with medical it is still possible to clear up problems directly with the office even if the balance has gone to collections.

Reporting Period is set by the FCRA. There are no provisions for extending it. Some state's laws allow SOL to be reset by a partial payment or promise to pay, but that has no impact on Reporting Period.

Insurance companies don't receive treatment. The patient or their legal guardian is responsible for medical bills regardless of insurance coverage.
