serenity06
I talked with Compliance officer today with NCO about the bill from MEDCLR. I told her I don't think that it is me as far as the ambulance bill. She told me that she was going to contact the OC and get an itemized bill from them of what they did. Can they do that? Also, the OC was contacted and requested a copy of the bill. They said in order for me to get a copy of the bill I had to request them in writing with a copy of my DL for identification. How can she (NCO officer) just request a copy of my records with identification and all? I think that is so messed up. Plus I thought that this bill was out of the SOL. It was 12/17/02. dpgirl
It is out of SOL as far as legal action. They can pursue this debt forever though. If they should sue you would answer that it has passed the SOL.You could send them a cease and desist letter if you don't wish to be contacted by them anymore. If I'm understanding this correctly though you feel this isn't your debt anyway so you want it completely gone. Have they violated any FDCPA laws or FCRA as far as reporting? If so at this point you can sue them for those violation(s) and they cannot sue you for the outstanding debt due to SOL. They would most likely just drop the whole thing. The NCO contact can obtain the info you are asking for easier because they are the OC is their client, not fair but that's how it is. If you don't want to write to them yourself then keep on her for the documentation.
stancil1
dpgirl is right, but if I were in your shoes, I would sent a letter to the OC requesting verification of this debt. An altered form of this letter should work fine. http://www.creditinfocenter.com/forms/sampleletter17.shtml You might also look at this thread : http://www.debt-consolidation-credit-repair-service.com/forums/showthread.php?t=263624&highlight=hippa
outforjustice
She can get a copy of the bill but not your medical records, they don't need your permission only your request for DV. If NCO is the CA, they can get a copy of the billing without your signature. This billing only gives the codes, dates, amounts, and identification of patient. Sign nothing!!! and never send a CA a copy of your driver's license or anyone else for that matter, CRA's yes, to prove you are who you say when getting information removed from your CR. serenity06
I am still a little lost. So if she gives me a copy of bill with code, that is considered DV?
dpgirl
What you need to do is contact the ambulance company yourself. You need to understand that NCO is not in any way going to help you to prove that you DO NOT owe this bill. They are NOT going to be of any help in proving that you are not the right person. Remeber that, no matter how nice this person may be on the phone. They only care about getting their money, they DO NOT care if it is from the right person or not.Send your own request in today to the OC and send it certified. serenity06
Is there a simplified letter for the OC for verification? I feel the letters above was too long and need help with a simplified version.
