MR.T
I have found out the company that is sueing me is not register to do business in this state. It this enough to get it dismissed? Can't believe a lawyer would take a case for this company. Looks likelawyers would check that out first thing.Still have the fact of frivolous lawsuit ... out SOL, too, but tried to reage after it was bought as a default debt from original creditor...and more violations...Thanks. someonesomewhere
I have found out the company that is sueing me is not register to do business in this state. Not licensed to do business or not licensed to collect? Doesn't appear there's any requirement for CAs to be licensed in Alabama.http://www.debt-consolidation-credit-repair-service.com/forums/showpost.php?p=445348&postcount=
nascar
I have found out the company that is sueing me is not register to do business in this state. Is the plaintiff's attorney licensed to practice in Alabama? That's what you need to know.
hawaiiguy
An attorney would be able to help you more on this. Unifund is sueing me in WA, they have one collection license but not the other which is required in WA. It is enough to vacate the judgement in my case. Try www.naca.net
Recovering Attorney
If they are not authorized/licensed to do business in Ala. make sure you have a lack of capacity defense. And do try the SOL defense.
