andknapp
I need some help on what to do with these people, they're driving me crazy.I first had an account with FNB Omaha, which got sold to Emerge Mastercard. They upped my interest rate so high, I couldn't even keep up with it, so within four or five months my balance went from 850 to 1676. It got closed and my account got sold to Midland Credit Management back in 09/2005 or so they say, they're still reporting it, however, I had started paying Simm Associates back in May of 2006 for the same account. I DV'd them about two months ago and they couldn't validate. They deleted the TL from my credit report. Now, FNB Omaha was also on my report as a negative TL, they couldn't prove I ever had an account with them either, so they deleted. So yesterday when I got my mail, there was a collection letter from a company called ARS in California collecting for this debt which is now up to 2000 for Midland Funding. Isn't Midland Funding just another name for Midland Credit? If they couldn't prove that I owed them money and it was with a completely different collection agency just one year ago, then how can they sell my account to a different collection firm? Should I just DV them and hope they can't validate or what do I do. I'm so tired of them calling and threatening me with being sued. Any Help?? Thanks!!! I'm so tired of them calling and threatening me with being sued.DV them, yes. But if they are threatening to sue, then you might consider a telephone recorder. Indiana is a OSP (One Party State) for the recording of phone calls--so you don't have to tell 'em you're recording and they are thus more likely to violate the law.http://rcfp.org/taping/states.html
