Can I file a motion to quash if the oc, ca, and the lwyr for the ca can' t validate?

I have been sued on a bank acct that was closed in 1998 with a zero bal, but rcvd a garnishment on 10-06! I went tot he bank first, but they had no info as they destroy rcrds after 5 yrs, they did supply a print out of the acct that shows transactions were made in 2000, du2 misapplied deps. md by a bank employee. In short, I had no idea what to do, so I contacted the CA per banks adv, then was told to cntct the lwyr handling the case. I ended up filing a slow pay, went b-4 the judge and was gvn until 12-06 to find out what was going on. I had a car wrech 11-20 and cldnt get a lot done, so the garnishment went w/the slow pay, but the crt hse sd they were not rcvng the pymts frm wrk.(cks show dedctns for writ each pay pd). The orig grnshmnt was reinsttd, went bk to crt on another slow pay. The judge has gvn me until 6-07 to strt mkng pmts. I have begged in writing, to validate the debt, but was told none of the parties have any of that info. The lawyer advised it was too old and he didn't have anything. I have also disputed this with the 3 CRA's. Any help at all is so greatly appreciated. I just don't know how to go forward since we have been to court.

Unfortunately, since you've gotten the judgment entered against you, it's too late to DV. I'd talk to a consumer protection attorney in your area to see if there is anything you can do. You can find one at www.naca.net
