Best route to take

First off I would like to let everyone know that stumbling on this site has been too good to be true, I have immersed myself in a wealth of knowledge that I can't begin to describe considering that I did not know my a$$ from my elbow as far as FCRA & FDCPA a couple days ago. With that being said, now onto the task at hand.

I have about a 570 credit score, in actuality I don't owe that many people. 1 debt I actually plan on paying off is my student loan, which is only about $3,000. I have two other TL's that I need guidance on deleting. To give some background, I have been living in NY for 4 years but all of these debts were incurred in FL when I was in college.

1. A company named Credigy Receivables purchased my debt from the OC which was Discover. The amount was about $1400 originally, but they have a balance in excess of $5,400 on my CR for all 3 CRA's. However, a company called Plaza Associates based in NY is now sending me letters trying to settle for the balance. This account was opened back in '99 and has been delinquent since '00, so I believe the SOL is up. I made the mistake of online disputing before finding this site and all CRA's has deemed the debt "verified".

2. The famous NCO Financial purchased a $1,200 MBNA debt and has a $3,000 TL at 2 of the big 3 CRA's. They have not tried to contact me in years, but this debt is also from '00 with the original OC and NCO's last report on my CR was back in '03. I haven't disputed this at all with the CRA's yet.

I've read numerous posts and guidelines, but I'm on the fence as to what is the best next step as I don't want to do the wrong thing and make it a more difficult process. Should I DV NCO before disputing? I'm really not sure what's the best approach with Credigy. Should I go at them with a DV and forget about Plaza Associates altogether?

Any suggestions will be greatly appreciated

The statue of limitations for New York is 6 yrs. Fortunately, New York is also one of the states in which payment after the account has been sent to collections, does not constitute resetting the SOL...only a written promise to pay! :lol: If the DOFD, date of first delinquency, was back in '99 or '00, you are past the staue of limitations. This means they can't sue you but they will still attempt to get the money from you. 8-) As far as interest on the account, this depends on your original contract if it was part of it. 88-) I would send Plaza Associates one of the letter on the forum that talks about them verifiying the date which includes proving the debt is within the SOL. I would leave NCO alone is they are not bothering you. :tempted: When they do, send them the same letter you are sending to Plaza Associates. Even though these debts are SOL, they still stay on your report for 7 yrs. :lagerlouts:

If the NCO debt is outside SOL, dispute with the CRAs while sending a "I found this on my CR and don't know why you are trying to collect an old debt that I am unaware of.....)" or something to that effect...

NCO folds easily these days and won't respond to the CRA and should get deleted without trouble. If it still within SOL, I would advise not waking a sleeping dog!;)

My error, Credigy was the company that verified my dispute. I haven't disputed the NCO which I'm toggling on doing since the SOL is up. As far as the Credigy debt, since they verified with all CRA's. Should I DV Credigy or should send MoV to CRA's?

I recieved a phone bill from Afni collection for a bill from 9/2000. I wrote them & stated it was not me.They sent me the original bill & when I called they had my SS# & DOB. I told them I have lived at my current address for over 8 years & I have not lived in that area for that period. The address on the bill was where my mother had lived but she has passed foer 2 years. They wanted me to call the police & claim fraud, what should I do?
