A personal favorite to say is:I AM RECORDING THIS CONVERSATION FOR EVIDENCE. IF YOU AGREE, SAY THE NEXT WORD. But, Illinois courts have found that the recording of a conversation by a party to the conversation is not a violation of the statute even if another party to the conversation is unaware of the recording. ocn2000 Posted April 3, 2007 Report Share Posted April 3, 2007 NO! You can record calls without the other parties consent in Texas. I have done it and used it as evidence in court. It does not matter where they are when the call is made only where you are ( in Texas) and where you plan onusing it in court (presumably Texas).
