Do I need both Parties consent to record calls in Texas?

Recommended Posts

HI, I have an issue with anfi and need to record my calls with them .. do I need both parties consent to record conversation in TEXAS?

Here is a list of all the states and if they are 1 or 2 party consent state.

Also, to make sure that you understand if they are in a 2 party and you are not, you need to make sure that they KNOW that you are recording.

A personal favorite to say is:

I AM RECORDING THIS CONVERSATION FOR EVIDENCE. IF YOU AGREE, SAY THE NEXT WORD.

This traps them into doing one of 2 things. 1 - hanging up on you 2 - being terribly abusive (which then you have it on tape).

Illinois 720 ILS 5/14-2"(a) Statute prohibits recording a telephone conversation without the consent of "all parties to [the] conversation." But, Illinois courts have found that the recording of a conversation by a party to the conversation is not a violation of the statute even if another party to the conversation is unaware of the recording. People v. Jansen, 561 N.E.2d 312, 314 (Ill. App. Ct. 1990).

NO! You can record calls without the other parties consent in Texas. I have done it and used it as evidence in court. It does not matter where they are when the call is made only where you are ( in Texas) and where you plan onusing it in court (presumably Texas).
