Recently sued - Need Advice

Recommended Posts

I was recently sued on an account that I assumed was no longer in statute. The creditor claims I made a payment 5 yrs & 11 months ago (SOL is 6 yrs in NJ). but the payment was returned NSF. Does this tranaction constitute an actual transaction that would have keep this account within the Statute of Limitations? If so, how long does the creditor have to collect on any judgment?

Sticky situation.....

I would look up the term "payment" in UCC code or in NJ "finance" statutes. Since it was not worth anything, there was no actual payment. Since you did not pay anything of value, your prior payment constitutes the final payment on the account to establish SOL....and THEY are the one's SOL.
