jen Posted April 4, 2007 Report Share Posted April 4, 2007 we had a situation last year that resulted in a TON of medical bills. one place in particular was really great about setting up an easy payment plan with us, for only $25/month. my husband is in charge of paying all of the bills and since they refused to send us invoices or a payment book, i made up a spreadsheet for him of due dates, etc, so he would remember to pay it. well, one month he forgot, so he double paid the next (and actually made the next payment early, so the missed payment was really only about 2 weeks late). i guess that ticked them off because i got a letter from a collection agency demanding payment in full. i spoke to someone there today and they said it was because of the one missed month, even though technically we are up-to-date on payments. if we don't pay in full by friday we are going to get sued on monday. there's no way we can pay by friday. can they do this or do i have some sort of rights? i can't believe one delayed payment would cause all of this when there are surely people who don't bother to pay at all? help and advice is greatly appreciated! thank you! You will learn why if they don't sue you on Monday, then you can sue them.It seems pretty militant for this particular provider to turn your account over to collections after one missed/late payment when you have a history of making the payments. Is this a doctors office? You may try to contact the doctor directly and speak to him/her about it. Very often the doctors have no idea what is going on in the business office and are willing to rectify this type of situation.The CA is just trying to scare you. stancil1 Posted April 5, 2007 Report Share Posted April 5, 2007 I would DV them immediately, and make them show you what they have. This will at least stall them and they will have to answer your DV because its within the 30 days. Did they tell you that they were going to sue you in writing or was it over the phone ? If it ever did go to court, chances are the Judge would see that you have been making payments on time every month. Hopefully the CA will make another mistake. You need them to get a DV BEFORE they file suit not after. Hopefully their threat is empty and is only a threat. Other than that, I agree with dpgirl's advice to read Divemedics guide.
