OC Re-aged???

I wasn't quite sure which forum would be right for this post. I'm quite sure it will be moved if incorrect. If it is, sorry.

I dispute a Cortrust account on my wife's CR and the results came back as "updated".:evil: Yeah, they updated alright. They changed the account history to 3 years ahead. I will copy the info down and see if I'm just reading too much into it.

PRE-DISPUTE:

Status: Account charged off/Past due 60 days. $xxx written off.

Date Opened: 12/2001

Date of Status: 07/2002

Reported Since: 12/2001

Account History: Charge off as of Aug 2003, Aug 2002 to Jul 2003

POST-DISPUTE:

Status: Transferred,closed/Account charged off. $xxx written off.

Date Opened: Same

Date of Status 04/2007

Reported Since: 04/2005

Account History: Charge off as of Apr 2005 to Mar 2007

Does this look like an attempt to make it look more recent. Or does it look like an attempt at re-aging? I'm a bit shaky on ready the EX reports. They don't give you enough legitimate info. But, I do know that they changed stuff and since they are an OC I don't know how to proceed. Any ideas? Thanks.

Forgot to mention. Cortrust put an "important message" on the investigation results to contact them at xxx-xxx-xxxx. Why so you can f&%k with us further? Right.

Looks like a possible violation, (not 100% sure yet) :confused:

of FCRA 623 (a)(3)- failure to report accurate information.

they can't just willy nilly change the date of CO.

When does your report say that this will be removed? does it change from pre dispute to post dispute?

(that's what's really important)

in addition you may want to do the Primer,

to get additional violations... ..:)++

To Whom It May Concern:

After receiving my free annual credit reports I noticed that you are reporting an account on all 3 major Credit Bureaus that is allegedly mine. I tried to dispute with the Credit Bureaus because I have no knowledge of this account. Not only have you verified the debt to the Credit Bureaus but you have made an attempt to make the account look more recent. You updated the Date of Status to 04/2007, when prior to my dispute the Date of Status was 07/2002. You also changed the Account History to read “Charge off as of Apr 2005 to Mar 2007” when prior to my dispute it read “Charge off as of Aug 2003”. I don’t even have proof that this alleged debt is mine and it appears to me you are trying to re-age the account.

Well, according to the Fair Credit Reporting Act, I am disputing this debt and its accuracy.

§ 623. Responsibilities of furnishers of information to consumer reporting agencies

[15 U.S.C. § 1681s-2]

(E) Duty of person after receiving notice of dispute. After receiving a notice of

dispute from a consumer pursuant to subparagraph (D), the person that

provided the information in dispute to a consumer reporting agency shall--

(i) conduct an investigation with respect to the disputed information;

(ii) review all relevant information provided by the consumer with the notice;

(iii) complete such person's investigation of the dispute and report the

results of the investigation to the consumer before the expiration of the

period under section 611(a)(1) within which a consumer reporting

agency would be required to complete its action if the consumer had

elected to dispute the information under that section; and

(iv) if the investigation finds that the information reported was inaccurate,

promptly notify each consumer reporting agency to which the person

furnished the inaccurate information of that determination and provide

to the agency any correction to that information that is necessary to

make the information provided by the person accurate.

Please forward all documentation on this alleged debt to me upon receipt of this letter. Please note that proper documentation is not a print out or bill from you but rather actual proof of the debt's existence. I also need documentation to back up your claim of status and account history. If you cannot provide me with this information, you must remove the alleged tradeline on all 3 Credit Bureaus (Experian, Equifax, and TransUnion) and send me a letter stating that you do not have the information to verify this alleged debt. I will also require a letter stating that you will remove the tradeline from my credit reports.

All of the other dispute results show a date of removal, but curiously, this account makes no mention of date of removal. I don't know what to make of all this. This is only 1 of several I have to inspect. I have just started going through all the results.

I wouldn't give them any specifics at all because if you do they'll just change it. You need to get them to violate several times before you'll have any recourse. Just have them verify that the debt is yours as well as give you what ever the backup is for such proof. Once you have several violations on them, then threaten with an ITS if the TL isn't removed completely. If you don't position yourself properly RIGHT now, they'll just change it and you'll have nothing on them and they'll just say that it was an honest error.
