niteeyes Posted April 6, 2007 Report Share Posted April 6, 2007 I just received my report from EQ, and Midland is reporting on the same acct. twice. The SOL was up on the debt in 2-07. I disputed with EQ, and have a DV letter ready to send. The OC was deleted. Now, should I wait on their reply, or go ahead and file complaints on the obvious violations with the AG, etc? EQ told me that they would investigate the account being reported twice, but there was nothing they could do about it right now. retmar Posted April 6, 2007 Report Share Posted April 6, 2007 What EQ is saying is they must wait for a response from the CA before deleting. Now, if you have proof the debt is the same on both TL's, send to EQ and demand it's deletion. But, you must have absolute proof.Since debt is timebarred, there is no need to send a DV for any reason. The CA and OC do not have any legal recourse available to them. Therefore, you only have to send a C&D to the CA clearly stating the debt is timebarred and they must go eat maggot droppings. Yes, file complaints with the AG, BBB, and FTC, and let the CA know you did. As to the reporting period, if the 7 year period has passed, or whatever your state says, the CRA must delete without further notice. Your post did not specify if the 2/7 date was for the SOL for legal action, or for SOL for reporting. I answered as to the date meaning the SOL for legal action. SOL is for the legal and EQ was quick to point out that they were going to report it for 7yrs.The odd thing is that I've never received one thing from Midland. Well, it appears to be both. On the EQ report it shows the date as 2-07 to roll off of my report, and the DOLA is 2-2001. The only proof that I have is that the account #'s are the same, all other info is the same, the only difference is that on one it says I owe $902 and the other says $903. This used to be FCNB. That's realy al I've got. Okay, I just right now found out the reporting period in our state is 6 years across the board.I really hate those guys! retmar Posted April 6, 2007 Report Share Posted April 6, 2007 A credit card is considered an "open account", and, as I read your state's SOL, it shows the SOL for legal action is 3 years.That is sufficient proof of a double entry. Compose your letter to the CRA noting all similarities and demand a deletion of the one with the later "reported from" date. Thye have 30 days.
