First American Investments / LVNV Funding

I had an old CitiFi CO on my files (all 3 CRAs), I sent a DV request to First American Investments and then disputed with the CRAs, after 2 months the TL fell off but the the CA/JDB (First American) never responded to my DV, now LVNV Funding has shown up on my reports as of 03/28/2007. This new JDB never sent me a dunning letter but has changed the balance on Experian to show $3083, but on Equifax it is still showing $2996. It was also due to fall of in may 2009 but on equifax it is slated to fall off now in 2015. Do I have a case against the first JDB for continued collection attempts and the second for re-aging ?

This sounds like re-aging to me. They are required by FCRA to use the OC DOFD. Not some random date they come up with. I would send them an FOAD letter. I'm dealing with a similar situation with Arrow Financial/TrueLogic. Hopefully it helps you out. Good luck. If you haven't read the post I gave you the link below. Something is really not making any sense. 2015 is eight years from now. Obviously this is re-aged but re-aging it so it falls off past the seven year reporting time period is odd, to say the least.

Do you have the actual hard copy of the report listing the date to fall off as being 2015? If so I would say you have a violation on the part of perhaps both the CA/JDB and the CRA. I would think the CRA should not be able to report a date that is so obviously in error.
