avalon Posted April 6, 2007 Report Share Posted April 6, 2007 I have been delinquent with my AMEX Credit Card since December 2006 because of a business failure. (The account balance is $29k) I qualify for a chapter 7 but am trying to avoid it. I am not in the position yet to offer a settlement yet. AMEX just sent my account to collections with NCO. They started calling on April 1 and I just sent the cease and desist letter from this website to stop the annoying calls. Yesterday, I received a letter from NCO stating that I have 30 days to dispute this letter the debt or they would consider the debt valid. Should I respond or blow it off? blooker Posted April 7, 2007 Report Share Posted April 7, 2007 I have a charge off from AmEx and they have yet to sue me or sell it to a collection agency. They sent me a letter to settle for less with the possibility of obtaining credit from them in the future.NCO - well that is my current battle. They hired an attorney to sue me for almost three times what i owed. I hired an attorney and claimed SOL has expired. NCO's attorney called my attorney to verify when the last payment was made. They say in 2004. MY records say 2000. The attorney said he will check with his client and if they cannot verify the payment, they will dismiss the case.
