TU's "Frivilous" Letter

Recommended Posts

In Saturday's mail, I get a letter from TU regarding a dispute I sent to them indicating they have previously investigated this matter and deeming my request "frivilous".

Before anyone posts the link to the Sticky, I've already read it...all 6 pages.

I'm sitting here looking at the DV Flowchart as I type this post, and as I understand it, I should wait until Day 32 to send a follow up letter to the CA. When exactly should I be contacting the CRA for MOV? Should I respond to them immediately, or should I wait until I've send out the 2nd letter to the CA? Do I do this in writing, or do I call them, and play stupid? Which is best?

Understand this is an old CA account and I did not do a timely DV, so I may never get a response from the CA.

Your opinions are greatly appreciated!

I would think that you should ask for MOV now. Tell them you want to know exactly who, what, when, etc. How many times have you disputed this? Cause I'm thinkin' I may have one of those letters coming soon on a couple of the stubborn ones.

This is only my second dispute. The first one was a long time ago, and I just disputed with the CRA, no DV to CA.

This time, I want to do it right. 1st letter to CA was mailed and faxed on 3/16/07, so the second one is coming due in just a few days. CA has already reported as "disputed" on CR. But since TU has decided it's "frivilous" will they remove the dispute?

So much to learn!

I don't think they can remove a dispute that comes from a "furnisher". You have every right under the FCRA to dispute directly w/the CA, OC, or whoever is reporting. Basically, you are bypassing the CRA to dispute. However, the OC, CA, or whoever has the same right to deem your dispute as frivilous. That's the letter you don't want to get! Just keep tryin' maybe the CA will cave. Good luck.

BTW, TU are A$$holes! Never have luck getting things deleted or even reported correctly. I get deletes on the same accounts that TU says will remain. How does that work? Then when you try to re-dispute they say they've already investigated and to send more information to re-dispute. Pain in the rear!

I used to never have problems with TU...in fact they deleted a judgement for me with just a copy of the cancelled check where I'd paid it (well after I called them when they said they wouldn't remove it and it was "verified"). I said how is it verified when I sent you a copy of the cancelled check...both front and back! It fell off within days.

Are you a 'consumer member' of TU?

My thinking is that they just might give preference to

their members...

of course,

they would never admit it...

but

every time I send in a letter, I just let them know..

"I am a member of your on-line service, my ID is ________"

and I have not any problems.

I look at it this way, they are a business and

like the CA's and OC's, you are paying them

and they want to keep you happy so you keep paying them.

For me, It's worth the few dollars a month to pay to

get a 'possible' advantage. besides I get to pull

a new report daily if I want and get on-line

notification of any changes.

In fact, I was just notified of an unauthorized inquiry( another thread I made)

and might just sue... countering any costs that this

service costs me... :-)
