No letter-what should I do?

Recommended Posts

I had back surgery a little over two years ago and got quite a few bills from the hospital afterwards. After sifting through all the bills, my insurance paid their share (with some not so gentle persuasion), and I paid the remaining bills. A year and a half later (Sept. '06) I applied for law school loans and was denied because of an outstanding collection account. I talked to the loan agency and got the phone number of the collection agency. I called them and they said that I had an account with them for just under $2,000. I tried to negotiate with them to get a better reporting since they had never even notified me of the debt, but ended up losing my cool (after she told me that the hospital would file suit on me) and telling them to send me a validation letter. I never got the letter.

At the end of February I got a call from one of their representatives and asked her to once again send me validation. I have not wanted to write a validation request because I have not even been sent a letter from the CA yet informing me of my 30 day period or the debt. They claim to have tried to contact me on several occassions, but will not tell me when they sent anything. I still have recieved no written correspondance from the CA. What should I do? Did the CA violate the law by not sending me a letter after our first phone contact, or upon acquiring the debt?

Carefully go back over your bills and payments. You say you paid all the remaining balances after the insurance paid.

You wrote that you tried to negociate a better repoorting, but were you able to determine whether or not this balance was one that in fact you had already paid? If you were at least able to get the name of the medical provider you could at least contact them and find out what is going on.
