MissSilence Posted April 13, 2007 Report Share Posted April 13, 2007 In another post I had seen it stated if DV is timely they must stop all collection activity immediately. They must also mark TL as in dispute immediately.My situation is I sent DV letters to CA last month I waited till they recieved them then disputed the accounts with both the CB's that have them listed. Its been 3 weeks and nothing has changed on my report. Like nothing is marked disputed and nothing saying anything is being investigated. Also have had no responses from anyone. I know if my DV was not timely that they dont have to stop collections or even respond to me But do they still have to mark the TL's as disputed? ad2s07 Posted April 13, 2007 Report Share Posted April 13, 2007 From my understanding, even if the DV was not timely the CA has to stop all collections and report the TL as being disputed to the CRA. They can take forever to respond but along as they don't report to the CRA and try to collect they are not violating. However, if they report without validating the debt with you first they are in violation. I would wait for the 30 days to be up and see if it will be deleted or verified and you can take it from there. But as you can see I'm new and this is what I have learned so far. They cannot report to the CRA without also reporting that the account is disputed. If they choose to respond to your DV, then they have to follow the law and not use false or misleading statements in whatever they choose to send you.In your case, wait for the CRA to complete the reinvestigation. They sent me some info that I don't believe constituted proper validation so I sent them another request which they have so far ignored. The TL is only updated as disputed on one report and not the other. Remarks: [TransUnion] Placed for collection [Experian] [Equifax] Consumer disputes - reinvestigation in progressSubject has not satisfied debt.
