Different 30 Day Late Strategy Question

I have two 30 day lates with an OC that I am trying to get removed. They are reported as late X month with one CRA and Y month with the other two. Word this work?

1. Dispute lates with 3 CRA's

2. If deleted great .......if not then

Would I send a letter to the OC or CRA telling them they are in vioaltion of the FCRA and demanding they are deleted? What do you guys think?

I have those too, but no success with disputing. One of the CRA's is reporting the wrong month for the late. All three dispute came back verified. Verifed I guess because I was late, but it is inaccurate when it comes to month of late payment. I just sent out my goodwill letter, so we'll see how that goes!

send a letter to the oc disputing the lates cmrrr. Then redispute with cra.

If they verify now you have them 2 times reporting innaccurate information which is willful noncompliance. Also, after you dispute with the oc, they should mark you cr in dispute, they usually never do. Another violation to use as leverage. Good luck!

Are you trying to remove the lates? Or the whole TL? If this TL is paid off, and you dispute through the CRA, you run the chance of the entire TL being deleted.

Tread lightly if you can't afford to have the TL deleted. It may send you into another category for the FICO and lower your scores. Better to write a really, really sappy goodwill letter. Get their heads really swollen and ask really nice to delete the lates. JMHO. Good luck.

I think I can afford to have it deleted, I made the mistake of closing it last year when we were looking for a house. The lates are from Jul 05, and Feb 06. The TL hasn't reported since Sept. 06. I know the lates are getting old, but we are looking for another house and need all the help we can get. Trying to get the number of lates down. I tried a goodwill a couple of weeks ago, but from what I read they don't work with the creditor.

Another option is email. Alot of people won't agree, but so far, I've been semi-successful with that. I emailed the CEO of Diversified Adj. Services (a really nice email). Within a 5 day period I received an email from the Vice-President of Operations saying they will notify CRA's to delete. That was yesterday and I haven't received the hardcopy, but he says it's coming. It's worth a shot.

I have reviewed the account you referenced. It appears to me that this account was reported accurately (we got nada, in other words). However, since the matter was resolved more than four years ago, we have decided to direct the credit reporting agencies to remove the item.

That is great news about the delete...

I am just wondering if I should mail the OC or the CRA about them violating the FCRA by reporting different dates or should I mail both? I am worried that if I just mail the OC, they will just fix the dates and I will have to consider my legal options. If I mail the CRA's, then they just may delete the lates.

Any thoughts?

You should write a nice letter w/a hint of FCRA violations for not reporting accurately. I wouldn't go for the throat right off the bat. It will definitely turn them off to helping you at all. You might just mention that you were reading up on your rights under the FCRA and noticed that they are MISTAKENLY reporting inaccurate information according to your records. Make them think you are the most organized person in the world and have every record for every transaction. Also, give them an out and create a shadow of doubt. It may have been a computer gliche or something.*hint**hint*.

Send another dispute to the CRA, telling them you never paid late. See if that will work.

If not, then use a little stronger tactic.

worked for me...didn't do online though. printed out a copy of my truecredit monitoring showing the different lates (in color so they could see the different colors on there) and two came off. One sneaky bastard OC decided to update their reporting to "match" though. Nailed them on that since they verified the wrong reporting dates twice. Waiting on their response. I thought I sent the letter out last week and found it under teh seat of my truck. Go figure.

Just a suggestion. Make sure when you dispute via CM with the bureau's that you cite the FCRA. That gets them to react a tad quicker.

How does one go about finding the CEO's email address. I have looked all over the web for Ray Fidel - CEO of DriveTIme Automotive Group, but have come up with nothing.

I need input on my many lates on my 1st priemer c/c. It is still open and current..but many lates but inaccurate across the 3 CRA...for example:

5/05: TU:60 days EX:90 days EQ:60 days

6/05: TU:90 days EX:60 days EQ:90 days

7/05: TU:120 days EX:90 days EQ: 120 days

1/06: TU:30 days EX:OK EQ:30 days

I am interested in the result of that letter because I beleive that it is the same OC. I am in the first stage, so they may try to update the correct dates with me as well.

As was said above be careful disputing lates throught the CRA. I had a late on a paid off mortgage from 3 years ago showing on all 3 CRA's. I tried all the goodwill deal and it didn't work. So i disputed it as not late through the CRA's EQ changed it to paid as agreed and my FICO is 773. Experian verified it and left it on and my score is 781. TU deleted the entire tradeline and it is my lowest score at 756. So my highest score is the one with the late on it, everything else on my reports are the same.

My late was through BOA and i tried writing to the ceo, etc. and nothing worked. Good Luck!
