craft_momma Posted April 14, 2007 Report Share Posted April 14, 2007 This is a 10 year old credit card debt. Already did a dv to the lawyer's office. Only thing I got was the original creditor. I do want to settle this. Going to court is not a option. Please any advise on how to word a settlement letter or any other advise would be greatly appreciated. At this time the lawyers office is only saying that Portfolio claims this amount is due them. I've not received a summons or anything like that. I dont undertand the big fear.. its easier for someone to take money from you.. someone who you don't owe it too.??? I am not giving you are hard time.. explain what can you be afraid of?? They will take me to court, they will make me pay anyway,it will be in our local paper, So if I'm going to have to pay I might as well do it now then have my name in the paper, take a day off from work. Let everyone I know in my small town that I'm getting sued. That's what I'm afraid of. I'm giving in to these blackmailers! I've not heard any advice to tell me a better way to handle them. CarolinaBlueEyes Posted April 15, 2007 Report Share Posted April 15, 2007 they print the crime reports.. in local papers and so what if your name is in the paper.. you need to DV them and make them prove your case.it may end up in court and thats something you have to face.. if they take you to court and your local paper prints this (never heard of that happening) your name will be there anyway... so get a DV to start and dont worry about the "neighbors"... this is YOUR life.... and its just a guy or gal in a robe.. with all due respect you are giving this way too much attention.YOu have rights.. you have the right to make them prove a case... and if you get sued and dont show its out there anyway.. so decide to fight it and not worry about the neighbors... no offense but you need to protect yourself if this happens and need to be preparedI mean this with great respect but its this attitude that angers me.. I am in the process of dealing with our congress to get laws changed.. one of the largest frustration is the fact that people don't show and get these bottom feeders what they want... the problem is HOW are we supposed to get the laws changed if consumers don't even want to help themselves... .. when my proposal made it to DC they congressman I spoke to mentioned he had NO idea the problem was as widespread as it is because consumers don't seem to care about their own financial situation.. why give away money when you dont need to... and give in to someone you dont even OWE the money too... you owe the OC.. not a junk debt buyer so make them PROVE their case Link to comment Share on other sites More sharing options...

I was in the same spot at craftmomma, before I found this site, tried to settle and they still took me to court, even after I settled. I know much better now and am kicking myself for letting them walk all over me. Hang in there craft, like CBE said you owe the OC not the JDB. Just dont give in and dont give up! CarolinaBlueEyes Posted April 15, 2007 Report Share Posted April 15, 2007 another issue that people seem to forget.. is even if you DO settle in some cases they can and DO sell the balance to another JDB who will go after you for the remainder and they can also take it to court.... so dont' think it always ends with the person who holds the current paper.. the way to go if called to court is hopefully have enough to get them to dismiss with prejudice.. then its over... for good and that peace of mind is worth more then a blurb in a paper that will be bird cage liner in a day or two.
