I have a repo on my record-should drop off report in 2008. The CA called me and we made an agreement for me to make payments (settlement offer that was about $3000 less of what was owed). Although an agreement was made, and they have my bank info (I know, stupid of me), they faxed me the agreement, but I did not sign it and send it back to them. Do you think they will go ahead and take the money out of my account even if I didn't sign the agreement?

Wouldn't put it past them! I would have DV'd them first before trying to settle. I would have never given my bank info to any CA!

I think what Dive means is that at this point you have already taken the steps to settle with this CA by giving your bank info and probably was not the smartest thing to do. We can't say for sure if the CA will take the money and run but it has been our experiences dealing with CA's that they are not the most honest of creatures! :?

They can always say that you agreed. Can you change banks or open a new account? Tell the bank that you feel your account number has been compromised and you need to immediately get a new account.

If you are successful in beating the CA to the punch I would then DV this CA. Pretend you never saw an agreement and don't know what they are talking about. If you do need to settle as I can see the debt is a large amount and depending on who the OC is, they could end up filing suit for the money, I would spend some time reading up on the best way to go about settling. Read the posts and the links above the forum before you take any action. If you take action before really knowing your rights, options or the ramifications of your actions, you could end up making the wrong decision. And then it could be too late to change anything. If there is anything we would like all those who have not dealt with CA's much to know is do NOT talk to any CA! All should be done in writing with the FDCPA backing you up!! Of course we are here to help guide you......if you ask for feedback BEFORE you have already taken action.
