Do I have this right?

I was about to dispute some medical collections as re-aging before I read up on some of the new posts. The date of first delinquency was 2003 the date of last activity was 2005 because claim I paid $1 on every account with them (there are tons). Did that payment reset the clock or are these still scheduled to come off in 2010?

I'm a little confused about that because there are posts debating when the actual date starts.

No letters, but the date they claim I paid was 2005. I wasn't very organized then so if they did send something it's long gone. I've been afraid to contact this particular CA directly because they have a bazillion medical accounts - some of which were included in an unpaid judgement. I would like to avoid garnishments right now.

I was hoping however that I could negotiate some sort of payment toward the judgement where they would at the very least delete the individual entries because the judgement will still be on there.

Did you get your bank to give you the statements from those months? If the payments aren't there, you have more ammunition and leverage. That would be my first step. Then you can go after them for re-aging and other FDCPA violations. ::BigGun::

The SOL for Oregon is 6 yrs. Oregon is also one of the states in which payment does NOT reset the statue of limitations...only a written promise to pay does! :lol:

That's no good. Is there a judgment on your CR's? If so, so much for Motion to Vacate for improper service. I would suggest visiting w/a lawyer. Explain the situation and see what they say. If it's already a judgment they may be able to advise you of the best plan of attack. A lot of them will give you a free consultation and if they see an opportunity for you to sue the CA for the violations, they may even take on a contigency case. Definitely seek a lawyer's advice.
