One Account-Being Sued by 2 Law firms

Recommended Posts

DH received summons on 3/1/07 from attorney for First American Investment, got great help here and answered summons CMRR, got green cards back on 3/21/07. We've been waiting to hear anything on this.

Now on 4/14/07, our neighbor brings over a summons that was taped to his door for DH. It's the same account he's being sued for by First American, however, the attorney is now Mel S Harris for LR Credit 12, LLC.

Can this be right? I know we have to answer summons, and I'm confident about doing so. I'm just shocked at this. How can 2 different "assignees" sue at the same time?

Any input would be appreciated.

okay I am not sure who DH is but I assume its a spouse.. actually this can happen... they farm out these accounts locally and there maybe more then one laywer that handles this.. you are not really dealing with brain surgeons here.... just respond to both as you have them and go from there.. I had a unifund account took a year to work out and they changed local lawyers three times.. after all was said and done and we reached and agreement I made payments and in that year two more lawyers had it.. five in two years.. so its not suprising.. stupid yes.. suprising.. no

Actually, the way I read this is that you are being sued by two different JDB's (American Investment and LR Credit 12, LLC) for the same debt, with each using a different attorney.

I would say you need to get a lawyer for this, but I think that you would have an easy time getting a "lack of standing" defense going on this.
