They are no longer on my credit report, but a collection agency now has the account and report it as a new account in 08/05. On one report they show the original creditor as ATT MAST. The other report just shows the amount (which is the same) from the ATT account, but does not show the ATT name.Can I write to the CRA and claim the debt is past the 7 year (+ 180 day) and have it removed? What will happen? Will the collection agency claim the debt is new? Requirements relating to information contained in consumer reports [15 U.S.C. §1681c]© Running of Reporting Period(1) In general. The 7-year period referred to in paragraphs (4) and (6)3 of subsection(a) shall begin, with respect to any delinquent account that is placed for collection(internally or by referral to a third party, whichever is earlier), charged to profit andloss, or subjected to any similar action, upon the expiration of the 180-day periodbeginning on the date of the commencement of the delinquency which immediatelypreceded the collection activity, charge to profit and loss, or similar action.Can I write to the CRA and claim the debt is past the 7 year (+ 180 day) and have it removed? It's always possible the CA will try to re-age, that's the way most lowlife CAs operate. It just happened to me w/a 6 3/4 yr old debt. It's a risk you run, but if you have a copy of the report prior to dispute with the old date, you can fight it, or even sue if you have better proof of the OC's TL and the DOFD w/them. BTW, welcome.
