dallas01 Posted April 17, 2007 Report Share Posted April 17, 2007 I have a Transouth call about a car that was late for the first time on 6/2003 and he's trying to collect the amount they didn't get from the sale of the car. I've check my CR's and it has them listed on my report but it shows repo with a high credit of 14,735 and a balance due 0.00 can they come and sue me? I sure don't want to call the guy and ask him when it was sold. I think they called about a year ago looking for me on this. I haven't had a collection agent call in so long its got me nervous. What they'll be after is the deficiency from the sale PLUS all the fees tacked on for storage, the repo itself, cost to sell it etc. However, if they failed to follow all the legally required steps for the repo and before and after the sale, they may have completely forfeited their right to collect a deficiency.
