Kat99
Hey everyone, have a quick question. On my 3 CRs, I have 2 medical collections that are negative TLs and they both show up as CAs collecting. My question is, if the OC turned it over to a CA, does it have to be reported on the CRs that the CA now owns it? I ask because I want to contact the OCs direct to try a PFD but am concerned that the CA owns it or is due commission if OC is paid and even if I get a pfd from the OCs can the CAs still report it? Thnx in advance for the advice I am sure I will rcv
retmar
Most often medical collections are assigned, not sold.If you approach the OC to see if they will honor your request, thus avoiding the CA entirely, state in your letter that you are sorry this occurred, for whatever reason. Then go on to say that due to how many CA's operate in the gray area by violating consumer's rights, and that, in some states, the OC can be held liable for these actions, you will only deal with the OC. Of course, you will mention that you are not responsble for their agreement with their assignee, etc. Then ask them to have their assignee delete the TL entirely. If they won't agree, you will seek other available avenues to resolve this.
pinkeysas
Is the OC listed on your CR? You can try to get the OC to accept your payment, I would ask them if they have a particular CA that they sell their debts to. If so then you might be able to ask that they pull the account back and let you pay them.If not and they still let you pay them anyway. And the CA still reports. You could send a copy of the receipt you got from the payment you made to the OC showing the account # to the CRA's to prove that the account has been satisfied and there for the CA should have nothing to collect on
Kat99
Thanks for the info/advice. On my CRs, it shows the creditor as the CA but it also shows the OCs name (medical) as the original creditor. Here is how it shows: Do you think I am safe to approach the OC for a pfd?Creditor Name:COLLECTION COMPANY OFAccount No.: xxxxx (I delted for post) Original Creditor: 11 SPRINT PCS Responsibility: Individual Condition: Derogatory Original Balance: $289 Balance: $325 Date Opened: 01/07/2007 Date Reported: 03/23/2007
