meowmix
Hi Everyone,I've learned so much from the site. I'm trying to help a friend get some things cleaned up to make herself eligible for a mortgage. She has several of the scum of the earth collectors (Midland, Arrow etc.) The Midland is the most pressing to get her score up, because it is posting as current. (Most of her stuff is old and will go away soon). She has a collection from MCM Receivables (I think the same as Midland). After reading this, my thought would be dispute with CRA & then DV with Midland. Are there any issues with doing this with the judgement already on the report.I don't think she actually went to court, so it could be a default judgement. I searched on line and do not see anything listed for her judgement for the county, but will have to check with them in the morning.Any suggestions on how to proceed. I was thinking dispute judgement with CRA (I think it is likely if I can't find it they can;t find it.) Then DV with Midland. They are outside of SOL, but it they do actually have a judgement that the county can't find, does that change anything for them? Thanks!
jkbowen1021
I know here in Ohio, they don't use the county courts unless it is a large sum of money owed. You may want to check a municipal court.
MadinKS
Any suggestions on how to proceed. I was thinking dispute judgement with CRA (I think it is likely if I can't find it they can;t find it.)Dispute the judgment, but understand that if it is a public record, that it could pop back up in the future. Without getting it removed from public record, through the courts, the CRAs, if they find it, can re-report it. As long as they give you the written notice of re-insertion within 5 days. Try to dispute it though. Who knows maybe they'll delete and you'll never see it again. If they got a default judgment, even outside the SOL, there's nothing you can do except try to get it dismissed through the courts. Sorry. Sounds like a trip to the courthouse of record is in order. If you do find the record, see how she was served. If it's served improperly, she has ground for a Motion to Vacate. Good luck.
