Swolf Posted April 18, 2007 Report Share Posted April 18, 2007 I sent out DV letters to everyone on my Credit Report. Last night I recieved a receipt for a paid in full collection from 11/03. It has been reporting as derog. on equifax ever since and paid on trans and EX but differnt none the less and was verified last month. Here is the ITS letter I wrote and want someones opion that has used this letter to get a deletion ont he account. However, I received a payment in full receipt from 11/07/03, and as being as such, this has been reported on my credit report as a “Derogatory” unpaid collection account for the past several years. I have been declined for credit cards, auto loans, and home mortgages due to this factoring on my credit report/credit score. At this time I am requesting that you “Delete” your entire account from all credit agencies including but not limited to TransUnion, Equifax, and Experian by Tuesday April 24th, 2007. Otherwise I will have no choice but to file suit against you for failure to co-operate within the laws of the FDCPA, FCRA, and State Laws. My hope is that you will just remove this account from my credit report so neither of us will undergo the cost of going to court. cjtx Posted April 18, 2007 Report Share Posted April 18, 2007 What recovering attorney is saying is that something from 2003 cannot be fixed with FCRA or FDCPA, so there is no point threatening them with that. You had 2 years and 1 year respectively to take legal action.Send your proof to the CRAs and ask them to remove it immediately.If they refuse to do it, you might have an action against the CRAs if they re-verify it. Have they verified yet?After you send your proof to the CRAs, write to your CA, but Instead of your ITS letter, change the second paragraph so you ask them to voluntarily remove the wrong information so you can resolve this issue amicably.If they verify the wrong date again or the CRAs refuse to correct the records, you will have some leverage, but not before they verify it. I saw it on my CR on TRansUnion,EXerian, but equifax is showing it at Unpaid Derog Collection. I sent DV to everyone that was on my CR and When I got the "Reciept". All I need for my morgage is 15 points. I am going crazy. But I digress, So actually Yes I just did notice it and I faxed a similar nutcase letter that admin has on the site, I am sending it CMRRR tomarrow, and told them they have 5 days to remove, so we will see. Maybe you'll even get it deleted.The thing with FCRA and FDCPA is that you can have an extension if you found out later using "due diligence". That means that if you applied for a credit card and they denied it some time ago, you could have asked for a free credit report to see what was wrong and that is when your limitations to sue for FCRA and FDCPA start tolling.Maybe I'm wrong, but that's the way I understand it.
