MadinKS
no, they do not have to delete if they own it.Even if the CA owns it, their dates, for the purpose of reporting, are SUPPOSED to be taken from the OC's records. Therefore, yes, the CA's TL SHOULD be removed at the same time as the OC. Did you just get a delete or did the TL die from the 7 yr virus? That's makes a big difference in what can be reported. If you were just able to get the OC deleted w/o the 7 yrs going by, then, no, the CA does not have to delete if they own it. We all know that the CA's use deceptive practices to keep things on our CRs as long as possible though.

If the jdb purchased the account form the oc then they did get the records from the oc when it was sold therefore they can report. However, all the info reported like dofd etc must be the same as the oc.

If I was to dispute an account w/ an OC and ask them to prove the account is mine. They have no records and the account gets deleted. However the CA claims to own this debt that that the OC couldn't prove is mine and also report it to the CB's. How can the CA prove your last date of activity? This doesn't seem right to me. I guess it doesn't have to.

Even if all they have is your name and an account #, they will report that they OWN the debt and when the CRAs send the dispute to them, guess what, they lie. That's why you have to DV them, and if that doesn't work, sue them. It's a huge scam and most of the time when you call a CA's bluff, they will cave. You just have to be persistent and forceful with them. Do you have old copies of your CRs? The proper dates for DOFD should be on one of them. I did send a follow up letter basically saying what they sent was junk and remove it or I will sue. I've read on here some have had success with law suits. Me personally, I would not attempt a suit without my attorney.

Keep in mind you should specifically ask for validation. There is a sample letter at the top of this board under the Debt Validation link.
