At this point,I'm giving them the benefit of the doubt, because of time constraint. My hearing is 4/27. My objection to levy,is that I've been on temp. disability since Jan . They levied my bank acct. and got my tax refund. Is it too late to request DV or discoveries. I did not check disputing debt or amt of debt. I wonder if I should have or if it's too late. Their demanding 3 month bank statements. What rights do I have left, any suggestions ? SOL is the beginning of june, I figure from last activity date, I guess I'll get my CR to see what that says. Did you file an appeal?The judgment has been executed, as per your post, so your options are more limited now, but you still may be able to fight it.Were you served and missed your court date or failed to respond on time? marimira Posted April 20, 2007 Author Report Share Posted April 20, 2007 thank-you for responding, On 4/9/07 I discovered posted on 3/28/07 my bank accounts read $1474. + $89. for NJ superior court FDES NNY, also $100. Service Fee Levy FDES NNY. Confused of who and why I went to pick up my mail and recieved documents 1. The levy on my account dated 3/27/07 cert. of service, 2. judgment for levy dated 5/11/05 almost a year and 11 months later. (Judgment states this order for execution shall be valid for 2 years from this date.) Also, handwritten on this "served levy 3/27/07 $1564" The POSTMARK is April 5 I picked it out of my mailbox 4/9 with one day to respond. And I have been home on disability, I thought they should have needed a signature on a cert. I filed a motion to vacate levy because of disability, motion to amend complaint/amend/answer, and I requested oral arguement. P.S. I was not aware I was served in May 2005 so I did Miss and did fail I suppose. My hearing is 4/27 next Fri. and getting a lawyer is not an option. Can I still dispute debt, request DV or discovery. SOL for this order 5/11/07, SOL for CC debt 6 years thats this june last activity 6/01. Sorry if I sounded long winded, but I feel so close to relief.
