vali1961 Posted April 20, 2007 Report Share Posted April 20, 2007 Dual state SOL – just to make sureIf after an opening a CC in state X (SOL 5 years) and after 6 months Joe Debt moves to state Y (SOL 4 years) and 3 years later he stops CC payments, which state’s SOL will apply to his situation. I understand is up to CA to decide in which state can sue, but Joe Debt lived only 6 month in the signing CC contract state(X), and he went delinquent after a couple of years in the new state (Y). Can CA still go after him in the original state (X) without being able to serve him hoping for a default judgment? CarolinaBlueEyes Posted April 20, 2007 Report Share Posted April 20, 2007 the creditor CAN but its rare.. they go after you in the state you live.. 99.9% of the time... and that is the sOL that applies.. he would be hard pressed to sue where you signed... I have read here it is possible.. but both lawyers I have dealt with said they have never seen it happen.you are pretty much bound by where you live.
