Hello

I am a newbie. I just received a letter from my bank that a judgement was entered against me. They frozen all of my accounts. Now I can not pay my bills. Is it legal for a ca to do this to me? I dont even know who the original debetor was. I never recieved any summons in the mail. Is this legal in NY?

They are also holding my joint account with my spouse.

In the majority of states, they can only garnish a portion of your income. In alsmost all states, if you are on any type of disability, they can't get to any of that money.

Search the internet for free or low cost legal resources in your area. From your post, it really sounds like they are over-reaching. You still have rights!!

Go to your bank and ask for a copy of the judgment. I'd think they would have to give you a copy or at least give you info as to who the OC, CA, etc. are and where it was filed.

That maybe would at least give you enough info to know what your next step will be.

I'm really not experienced in all this but legally standing, I don't think the bank could just "say" there's judgment without giving you some kind of proof and info.

Maybe someone else could step up and let me know if I'm wrong about that!

ps...also, have you pulled your CRs to see what info you might have on them to see if you can figure out who might have the ability to to do this?
