Struggling with Asset

I've been reading up on the posts re: Asset Acceptance and find myself in a similar situation. Here's the rundown:

My hubby rcvd letter from Asset in 12/2006. DV'd and rcvd bogus statement on Asset letterhead. DV'd again basically stating such and rcvd a form letter asking him to call the representative assigned.

As for the CB's, Asset is showing up only on EX & now TU. We disputed, now the accounts are blatantly reaged. We have sent a letter to EX requesting MOV, and are still waiting for results from TU.

DV'd Asset again stating violations, asking again for validation and removal of TL if unable to do so. Rcvd same form letter as before stating that they "are in receipt of my correspondence" and to please call.

So I am stuck at what to do next:

The OC was removed by dispute from all 3 CR's in 11/2005. So, calling them won't do any good.

The only thing we have is the 3 CR's from 11/05 with some similar info. From what I can gather the DOLA is 1/01, which should be about right, and makes this past SOL. 6 years for written contract in GA. The TU CR shows the "estimated date of removal" as 12/2007 which pretty much fits with the DOLA of 1/01. The EQ CR shows a DOLP as 5/01 which coincidentally matches the statement Asset sent to us. I am certain this is not possible given our situation at that time.

This 5/01 date does concern me, given 6 years puts that at 5/07. I wonder if that is Asset's hope that we will pay?

We have nothing from the OC, all our paperwork was destroyed in a PCS move 3 years ago. I so wish I had it now, I even had some old CR's!!

I'm not really interested in suing. We are in the middle of another lawsuit that has already cost me way too much. We worked so hard to get our credit cleaned up to have these idiots pop up!! Do I send another letter? It seems we all keep sending letters to no avail! I want these guys gone!!

I certainly wouldn't call them. I would send them a final letter stating such and once again, advise them that they have not provided validation per the FDCPA and list their violations (including those 2 joke letters they sent telling you to call them). If you truly aren't interested in suing then try going the route of filing complaints with the BBB and the AG. I have had hit and miss experiences with that route but it certainly doesn't hurt to try and I have had items removed as a result of that method.

How did you determine it was re-aged? Was the date of removal changed? If so, definitely put complaints in w/your AG, the FTC, and the BBB. Also, send them the letter like whoamelly explained and tell them if they don't delete you intend on retaining a lawyer. It gives the impression you're willing to go to court w/o actually threatening suit. JMHO. Good luck.

Yes, the date of removal went from March 2008 to July 2013 after the investigation. They are also adding interest each month. I am in the process of creating yet another letter. Thanks for the advice on filing complaints, I will do that. Has anyone gotten rid of these guys? If so, what was your strategy?
