malcolmkms Posted April 24, 2007 Report Share Posted April 24, 2007 Hello All,I'm currently deployed to Iraq, my wife is back home she gets a call from a CA around Dec, they we're trying to collect on a twelve year old debt, so my wife not knowing what we know now she gave him a check by phone for $200 and told him she would speak to me about taking care of the rest. She didn't tell me about it right away she figured I had enough on my mind. So I'm telling her about this site and all the great things I've learned so far, I'm exicited she's exited and she tells me about this payment that she made with a check by phone. She says this guy calls and leaves a message at least once a week like clock work, he want's to set up another payment. Now this has been since December he's not attempted to withdraw anything else out of the account but I know how shady CA's can be. If you we're us would you close the account? thomassl Posted April 24, 2007 Report Share Posted April 24, 2007 The SOL for Virginia is 5 yrs. for written contracts ad promissory notes and 3 yrs. for oral contracts and open ended accounts. Credit card payments are considered open ended accounts. As you can see, you were way past the SOL for this account! You are also in one of the few states in which sending payments do not reset the SOL. The SOL for your state can only be reset with a "written promise to pay"! malcolmkms Posted April 27, 2007 Author Report Share Posted April 27, 2007 I went ahead and opened a new account but I had to leave this one open because I couldn't get the new account opened in time to get my pay transferred to the new account so my pay will go into the old account one more time but I will transfer the money as soon as it gets there.
