shelms5 Posted April 24, 2007 Report Share Posted April 24, 2007 I am new to this and just have a few questions. I am trying to clean up my CR and have submitted a few DV letters to CA's. I got a reply from one (asset acceptance) it was just a statement and not a payment history. The others I havn't heard from and doubt I will due to the fact that I am past the 30 day dispute period. How do I proceed to remove these debts from my CR if the CA ignores me?#2 I also disputed some accounts with the CRA. They came back as verified. I then called the OC and was told by HSBC that they did not have the payment history,that I needed to call the CA. I was then told by First Premier that all they had in the form of records would be copies of the billing statements and that I would be charged $3 per statement for these. I in turn called the CRA and gave then the name and number of the individuals I spoke with. They re-opened a dispute but acted like it was a waste of time. thomassl Posted April 24, 2007 Report Share Posted April 24, 2007 Remember that CA's do not have to respond to your DV. If you dispute with the CRA's, the debt is yours and within the SOL, be prepared to possibly have to pay for them. You need to have a current copy of your credit reports so that you know who actually owns the accounts. Also remember whenever the CRA's verify, you have the right to ask them their MOV, method of verification...the who, when, where of how it was verified. There is a letter on this forum for such a purpose. If they verified, make them tell you how they did it! We here on the forum try to stay off the phone as it's more vital that you have a paper trail. This is why most of our correspondence is by certified mail. Especially the one's that don't have records. http://creditinfocenter.com/repair/DisputingWithOriginalCreditor.shtmlIf you can't get the CA's to verify to you and they're not marking your CR as disputed, they're in violation. The only thing required by FCRA, outside the 30 day window, is that they mark your CR in dispute. If not, violation. If they do that after 2 disputes, send them an ITS letter. Tell them if they don't validate w/you, and verify the TL, they are in violation and you will seek a lawyer. If that doesn't work, which some CAs don't care about lawsuit, one being ASSet, you will have to follow through and sue to have them removed. BTW, welcome. merkurfan Posted April 24, 2007 Report Share Posted April 24, 2007 ya just sol (the outta luck one) if they mark it in dispute and never verify? Arrow and Lvnv did that to me. They are listed under open accounts (just disputed that, those butt holes should be listed under collections) and of course 120+ late. I tried the 1, 2 punch.. and that is how it ended. Sometimes it almost seems like a game to see who can pester who the most, if your getting the best of them, it won't take long before they quit verifying, but, as I've found through experiance, threatening to file law suit doesn't scare them at all, however, receiving summons papers does. So if all else fails, once you get enough violations to make a good solid case against them, just pay the little bit of money it takes and file suit.. It's MUCH easier than you think.
