Which just shows, that if you fight asset acceptance, they will fold..Funny thing, the bailiff guy thought I was the plaintiff!! When he walked me in the room in front of the judge, he said "The defendant is not here".. I was like :" Wait a minute, I am the defendant! They plaintiff is not here!!" heheheJudge dismissed the case at plaintiff's expense. He said :" You are free to go" and I asked him if they can file the lawsuit again.. he told me, they probably didn't show up based on what was in discovery. I never showed him any documents or anything. He said he doubt they would sue again...All together, I was in court room maybe 30 seconds....It's funny because once my time hit, I was thinking:" Hmmm what IF they dont' show up??" and sure enough.. they didnt... kemiren Posted April 25, 2007 Report Share Posted April 25, 2007 I had to appear in court to for a credit union loan for $385 about 4 years ago and they never showed up. I ended up being the last person in the court room and they asked me what my name was and I told the judge. He said that the credit union never answered at roll call and that I could go home. I wonder if I could actually go back to court house and check for disposition on the case. Which just shows, that if you fight asset acceptance, they will fold..Let's not overgeneralize here.However, I remember reading an Ohio case, where Wolpoff was suing a consumer over a $12,000 debt, and dismissed their suit once they were pressed for proper assignment docs. There is a lawyer out of Ohio, that very recently has been very aggressive going after W&A and Javitch, Rathbone (I think) defending consumers against collection suits and going on the offensive with FDCPA suits.
