If OC reports TL as collection/CO are they now considered a CA?

Hi All!

I was just thinking about this - more like confusing myself - with regard to a GMAC TL that I'm disputing. I DV'd and am anxiously awaiting their reply (or not)! :lol:

When I first disputed, they immediately (within a week) verified and updated my CR's incorrectly - again- as well as reaged the account.

Since GMAC is reporting as a collection/CO, is it possible that they have their own in-house CA and I can sue them? Or will they still be considered an OC? I'm in Nevada if that makes any difference.

Thoughts?

Keep in mind CO is just an accouting term...an OC can charge off the account and still try to collect on it. Or, they can sell/transfer it to an internal/outside company. For example:

Company A <- OC

Company A charges off account <- accounting entry

Company A transfers/sells account internally/externally <- this is the CA

Yeah, I was afraid of that. I was kind of hoping that since they flagged it as "Collection" that I would have some recourse. I'm just kind of planning my strategy if they decide to come after me as it is w/in SOL.

My defense is that I don't owe the bill - which is true. I'm prepared with what I hope is satisfactory documentation to get it dismissed or settled in my favor, but I was hoping I could get them on some violations.
