merekelly Posted April 26, 2007 Report Share Posted April 26, 2007 I received a letter that states the followingPO Box 3023Hutchinson KS 67504Jane Doe123 Anywhere StreetOz, IL 12345Message AlertVoice Message NotificationMessage ID 1235467AUtomated Voice Message NotificationAn automated voice message has been left for you and needs to be retrieved by phoneTo retrieve the message that has been left for youCall Toll free1-800-831-8706To Access the message and confirm reciept, please enter the followingmessage ID -1235467Your message can be retrieved 24 hours a day........................................................................................................Nothing else is indicated - Well I researched the address and the internet and lo and behold, I find out that it's a CAIs this some kind of sneaky way of contacting you and should I consider it first communication.Aren't they also in violation of not stating that they are attempting to collect a debt and also not stating my validation rights?Can i consider this first contact and send them a validation request and let them know that they are in violation of my rights?Just wanted to be sure I got my ducks in a row!Thanks Link to comment Share on other sites More sharing options...

I don't see why that could not be construed as "first communication"- and that would put them in violation of:§ 807. False or misleading representations(11) The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector.Will be interesting to see if they follow up in 5 days... IF they don't- then they will be in violation of § 809(a).IMO- I would wait out the 5 days- just to see if they violate again, and if you don't receive anything, then send the DV.Hopefully, somebody else will offer an opinion also. merekelly Posted April 28, 2007 Author Report Share Posted April 28, 2007 Thanks for the info everyone, I googled the number and came up with the Better Business Beaureau info on the company which includes their address and the owner of the company.
