Advice Before I Call Please

Yes, I KNOW I should never call. However this call is in response to a possible old (but not old enough) judgment. Everything has fallen off my credit report except those things I've made arrangements to pay, so I'm not completely sure what this debt is. Therefore, I do need to speak with the collector at least once more. If this is indeed the judgment then I know from you wise folks that I should make arrangements ASAP (at least I think I know that).

Anyway, the collector called today and I want to move on this, but not without advice. I really don't have money. When I spoke with her the first time she was looking for a "sizable payment" and I suggested an amount I really can't afford. I know she's looking to make some kind of arrangements but I have a feeling I'm not going to be able to make the monthly she wants. Obviously I want to avoid court and I want to avoid hurting my pretty credit report I've worked so hard on. But I really don't have much money. What to do? Any words of wisdom?

Yes, DO NOT call, Handle all of your communication in writting. If you call them, they are just going to record the call to use against you as well as attempt to cause you to violate. How long until SOL expires ? Communications by way of snail mail can really drag out a situation. Do make sure that all of your communication is via CMRRR. While your waiting on their response to your first letter, READ ReAd read. Since your not completely sure what this debt is for, I would first ask them what it's for and who the OC was and then just take it from there.

I don't believe in talking to CA's either! :twisted: Since you insist on talking to them, it's best you get their full company name and address so you can send them a certfied DV letter. Make them prove you owe the debt and they are the rightful ones to collect. Is the debt within the SOL for your state? xheadscratchx Do you have your most recent credit report? After viewing your report, have you disputed it with the CRA's? If it is a judgment, whatever damage is done has already happened. :roll: They just might be trying to get the money. Give us the specifics from your credit report and let the ones on the forum help you through each step. :)++

Thanks for getting back to me. It really makes a difference when I feel supported!

My current credit report (which I got last week) is clean as a whistle. It shows a few accounts I am currently paying and few that are paid off. No negatives.

My credit report from three years ago showed a civil claim judgment that was filed in 2/00. It indicates that it was scheduled to come off my record in 2/07 and that has obviously happened. However, the SoL for judgments is 20 years in Massachusetts, so even though it's no longer on my credit report, I've been told they can still come after me with both guns.

I am almost certain that this is the debt that they're trying to collect. I spoke with someone from Stuart (or Stuart) & Assoc, P.C., Attorneys at Law last week but unfortunately was way too freaked out to get all the info I should have. The collector said she would get back to me this week after she "played with numbers" and I received that phone call today.

I've been told that because there is already a judgment here I have fewer options with regard to how to deal with things but I'm really not sure. I'm not calling her before I have a sense of what to do.

Okay, what do I need to know about Stewart & Associates and/or how do I find out? When I google all I get is a site for their offices and the sense that they have their finger in everything. Are they the Big Bad? Worse than most?

I am planning to call at least to make sure I'm right about what debt this is. Do I need to handle this differently if there's a judgment?

If it's the ones from Suwanee GA, they are associated with / aka Credigy Receivables, well they have the same address.

You can also use switchboard.com (or there is one thats whoscallingme or something like that others here have used) to reverse check the phone #.

No matter if is the same or a differnt CA, listen to thomassl and stancil1 or you'll prolly regret it.

If they already have a judgement they will be able to send you all you need to know by mail and if they don't you may reset the SOL by a slip of the tongue, not sure what it takes in your state.
