Collector Calling Family - Can He Do That?

A collector is trying to collect a credit card debt from my husband -it's his debt, not mine. He has called numerous times and my husband finally stopped taking his calls. I spoke with the collector twice as an intermediary. No arrangements were made with the collector - I just told him I would pass on the message to my husband. Now the collector has called several of my relatives and asked how to get in touch with me or my husband. I don't think he told them he was trying to collect a debt, but is it legal for him to even call my family? It was embarrassing!!!

is extremely embarassing and upsetting to family members. In my case one called my elderly mother and another called my Mother-in-law. If I wanted everyone to know my business I would rent a billboard on the side of the road.

I have faxed and mailed a letter asking them to C&D calling third parties and they did stop. The ones I'm dealing with now are collecting for Citi so I'm not sure how to handle them.

Shoot them a letter and should stop...

Creditor interchange called and harassed my sister-in -law. This was extremely embarassing for me because me and my sister-in-law don't get alone. But anyway they threathen to take her to jail. I sent them a C&D letter and filed a complaint with their AG and with the BBB and I never heard from them again and the best thing about it they removed their TL from CR. In a way they did me a favor I got a delete. If I were you I will file a complaint with their AG and with the BBB saying that they are harassing family members, it worked for me.

Thanks. What does AG stand for?

AG stands for Attorney General, File a complaint with the AG in the CAs state and in your state also. There is a sticky on this site that will help you to find AG for different states, also file a complaint with the BBB this may help you to get a delete, if it's on your CR.

This man is a representative of the OC - Chase Bank. The account was CO and he was trying to collect.
You need to be certain. If indeed it is the OC calling, they can be pretty much as nasty as they like. There are harrasment laws to protect you...but, the FDCPA does not.

On the other hand, if the debt is past due long enough to have reached the so-called "charge off" stage, (in other words, its been at least 120 days since you made a payment) chances are this is a collection agency, or maybe even a junk debt buyer calling. Those people are bound by the FDCPA and must behave themselves. They're allowed to call other people to try to locate you, but, if they know where you are, they've violating the law.

A few months ago I had trouble with GC Services calling my Mother-in-law. Citi was/is the owner of the debt but farmed it to GC for collections. I C&D third party calling and they did stop. I then shot a letter to Citi via Planetfeedback and complained about the calling of family members and they answered the letter with an apology and that they have instructed GC not to call third parties anymore. They haven't and I think the account has gone to another CA who are now calling my relatives. UGH!

Wow... yeah for 40G I hope you're beyond SOL (statute of limitations), they might come after that.

I don't know about general collections, but man in 2000 when I moved and stopped paying my car they called all my family, told them what it was for, pretended to be detectives, threatened to jail my mother for "aiding and abetting" and all kinds of nasty stuff...

Wow, my father has a bunch of CO's on his CR and they get calls all the time from CA's ,so I was visiting my parents and I guess the phone rang while we were talking and my 3 year old picked up the phone and he was playing with the phone. We didn't think he was on the phone with anyone, we didn't know the phone even rang. I guess he pressed the speakerphone button and I could hear the lady yelling at my son. Can you believe that?!?!

The rep is from Universal Fidelity - they collect for Chase Manhattan Bank. I couldwrite them a letter, but the damage has been done. He called and created alaarm among my relatives. Now they are calling me asking :Who is this man? What does he want? Are you in trouble? He had all of my husbands and my phone numbers. We were just not calling him back until we sorted out how to deal with our financial mess. What recourse do I have?

Okay then...its a collection agency (a CA)...they are bound by the FDCPA. They are permitted to call relatives and/or neighbors in to locate you. If they already had your phone number and if they had already talked to you, then calling anyone else is harasement and a violation of the FDCPA. You should indeed write them a letter pointing that out and that all further contact should be in writing with you...period. (If you're so inclined, you might even think about suing them for the violations).
